Airline or Volaris.- Concesionaria Vuela Compañía de Aviación, S.A. de C.V.
Airport.- Civil public service aviation track with appropriate facilities and services to receive and dispatch aircrafts, passengers, cargo and mail from scheduled air transportation service.
Ticket and/or Schedule.- Physical document or a document identifiable by a number of password in Volaris electronic systems, including the PNR, the passenger name, route, date, schedule and fare of the air service being contracted.
Call Center.- The Volaris call center whereby the Passenger may require information, acquire and/or exchange the air transportation being contracted.
Passenger.- Individual receiving the scheduled domestic air transportation service.
PNR.- Alphanumeric code identifying the scheduled domestic air transportation service being contracted.
Clause one. Air transportation service.
Volaris shall render the scheduled domestic air transportation service to Passengers, from a place of origin to a place of destination, subject to the terms, conditions and policies published in the Website and accepted when contracting the service by any Volaris purchase means.
Passenger, as consideration, agrees to pay certain price and money plus the taxes, dues or charges such as Value-Added Tax, the Airport Use Rate or the Safety Review Charge or any other that may apply from time to time.
Clause two. Passenger.
Passenger is bound to pay the airfare and comply with the governing law and Volaris policies, terms and conditions.
Passenger is entitled to be transported, to carry its baggage, which shall mean a suitcase containing clothes and personal hygiene items. It is also entitled to carry a small suitcase with valuable items in the compartment corresponding for that purpose or that provided by the crew.
The Passengers, when contracting the aforementioned services must provide true and correct information. In order to use the air transportation service, Passengers must show a valid official ID.
Party purchasing the Ticket agrees to the terms and conditions hereof, therefore, the Passenger agrees to check the Website from time to time for modifications.
Clause three. Passengers with special needs.
Those passengers requiring oxygen cylinder, wheelchair, pregnant women, infants, minors without an adult during their transportation, people with different capacities and special needs that may travel, may request the services they require when purchasing their Tickets.
Based on the applicable laws, the Airline shall state the facilities that may be provided and, if applicable, the additional cost and notify the corresponding instructions in order for the service to be rendered.
Those individuals requiring an additional seat must request so when booking or buying their Tickets so the fares applicable at that time may be notified:
Clause four. Tickets.
Tickets are nontransferable and non-reimbursable. Passenger is bound to check that their name is written down correctly.
Clause five. Documents.
Passenger must be present at Airport counters at least 120 (hundred and twenty) minutes prior to the flight departure time.
In the event the Passenger checks-in in alternate terminals to the Airport, he/she must be present at least 150 (hundred and fifty) minutes before the flight departure time.
Once the Passenger has checked-in, he/she must be in the waiting room at least 30 (thirty) minutes before the flight departure with his/her boarding pass and official ID which must be shown to Volaris’ staff in order to board the aircraft.
Noncompliance by Passenger with these requirements shall release Volaris from any liability, since negative actions or actions contrary to the order and control endanger Volaris operation in detriment to those Passengers complying with the requirements set forth above.
Passenger may carry on domestic flights up to 25 (twenty-five) kg. with 2 (two) pieces of baggage with the weight limited stated above.
If more baggage than that allowed is carried, Passenger must pay excess baggage according to the applicable rates plus the corresponding Value-Added Tax per each additional kilo.
In any event, excess of baggage may be transported depending on availability of room in the aircraft.
Any baggage must be identified outside and inside with the Passenger’s name and domicile.
Passenger MAY NOT CARRY in checked-in baggage money, jewelry, securities, electronic devices such as radio, mobiles, computers, cameras, among others, medicines, perishable items, liquid or fragile items. It is also forbidden to carry any kind of gun, gases, flammable substances, lighters, corrosive, explosive articles, magnets, among others.
Volaris shall not be responsible for the loss of the items mentioned above, which shall not be considered as baggage and are transported without Volaris consent.
In the event that for any circumstance their baggage does not arrive at the conveyor belt where all baggage arrives, before leaving the sterilized area, Passenger must file a baggage claim to Volaris staff in charge of baggage. Likewise, he/she must proceed similarly in the event of a damaged suitcase.
Baggage destruction or damage: Indemnity for destruction or damage to baggage shall be according to the provisions of the Civil Aviation Law, indemnity for carryon baggage shall be equivalent to 40 (forty) minimum salaries. Loss of checked-in baggage shall be equivalent to 75 (seventy-five) minimum salaries, taking as basis the minimum general salary in force in Mexico City at the time of damage.
Baggage Delay: in the event Passenger arrives to the place of destination but his/her checked baggage has not arrived at the same time as Passenger, upon request thereof, the Airline shall provide him/her per every day without the baggage being delivered, the amount of $250.00 (two hundred fifty Pesos) daily up to three days, that is to say, that he/she shall receive a maximum of $750.00 (seven hundred fifty Pesos).
Clause seven. Sale in excess or cancellation of flights.
According to the provisions of the Civil Aviation Law, in the event Tickets are issued exceeding the available capacity of the aircraft or the flight is cancelled for reasons attributable to the Airline (weather or external events preventing the flight are not attributable to the airline) which may not allow boarding, the Airline, at the Passenger’s discretion, must:
Reimburse the price of the Ticket or the proportion corresponding to the part of the non-traveled trip.
Provide passenger with all the resources available therefore, a replacement transportation in the first available flight and provide him/her at least and free of charge any telephone or cable communication service to the destination point, and food according to the waiting time until he/she may take any other flight; staying at the Airport’s hotel or the hotel of the city where he/she must spend the night and, in the last event, land transportation from and to the Airport.
Transport him/her on a further date agreed by the Passenger to the destination to which boarding was denied
In the event of Fractions I and III above, the Airline must also indemnify the affected Passenger in an amount not below 25% (twenty-five percent) of the Ticket’s price or the part of the non-traveled trip.
Clause eight. Fares.
According to the Civil Aviation Law, fares are freely fixed by Volaris, and must be solely registered with the Ministry of Transport and Communication for them to become effective and restrictions they are subject to must be clearly specified.
Clause nine. Volaris Information and Advertisement.
Any information and advertisement provided, shown or disclosed by Volaris by any communication means: Volaris fares, terms, conditions and policies, characteristics of the services, is professional, true, provable, clear and easily identified by Volaris brand and in tune with high quality of its services.
The text, images, data, graphics, trademarks, logos on the Website are Volaris proprietary information or its use is exclusively granted to Volaris and their rights are protected by the Intellectual Property Law and its Rulings, the Federal Law of Copyrights and its Rulings and International Treaties, therefore, the Passenger may not use them.
Clause ten. Disputes.
Passenger theretofore agrees that competent authority to settle any kind of controversy with Volaris is the General Department of Civil Aeronautics subordinated to the Ministry of Transport and Communications, therefore, he/she may appear to the Airport Commander’s Office or directly to the General Department of Civil Aeronautics. Federal Consumers Bureau shall be competent as applicable.
If applicable, the parties submit themselves to the competent courts and federal applicable laws, waiving to any other forum that due to their present or future domiciles may correspond or for any other reason that may correspond thereto.
This Agreement is in process of being registered in the Public Registry of Adhesion Agreements of the Federal Consumers Bureau.
